Introduction
Ally is an Elementor plugin that detects accessibility issues and offers guidance.
These Terms govern your use of the plugin only; feature descriptions appear in the product documentation.
By using our services, you agree to comply with these terms and conditions. Please read them carefully. If you do not agree to these terms, you should immediately cease making any use of the Ally Web Accessibility Plugin (the “Plugin”).
“Elementor” means Elementor Ltd., including our subsidiaries and affiliates worldwide (“Elementor”, “we”, “our” or “us”).
Eligibility
When you register for the Plugin services, we may authenticate your identity through different third‑party services and request additional identification.
Feature descriptions
1. Accessibility Statement Disclaimer
Our Accessibility Statement Generator is provided as a tool to assist you in creating a customized accessibility statement for your website. However, the generated statement should be reviewed and tailored to ensure it accurately reflects your website’s specific accessibility practices and compliance efforts.
We do not guarantee that the use of the Plugin will render your website fully compliant with any specific accessibility laws, regulations, or standards, including but not limited to the Web Content Accessibility Guidelines (WCAG). It is solely your responsibility to ensure that your website meets all applicable accessibility requirements. We recommend consulting with qualified accessibility professionals to achieve compliance.
2. Violation identification
Our tool scans the content you provide and highlights things that might not meet current Web Content Accessibility Guidelines (WCAG), including versions 2.1, 2.2, or any future updates. The list is only a starting point, some flags could be wrong, and we might miss others. You must review every item and decide what, if anything, to fix.
3. Remediation suggestions
When possible, we show tips or sample code that could address a flagged issue. Treat these as ideas, not promises. You are responsible for testing, applying, and confirming that any change really works.
4. Usability optimization
We also share best practice advice, such as improving keyboard flow, screen reader support, and color contrast. Use what helps, but make sure it works for all your users before release.
5. Regulatory alignment updates
We aim to keep our rules in line with current accessibility laws and internationally recognized standards. However, updates can take time. It is your responsibility to stay informed about the rules that apply to your situation and ensure your content remains compliant, even if our tool hasn’t yet reflected recent changes.
Technology Partners
Certain features in this Plugin rely on third-party technology providers (“Technology Partners”) to deliver AI-powered services. While these integrations are part of the Plugin experience, Elementor merely serves as a platform to enable access to those services and does not vet, endorse, or control them.
Elementor bears no responsibility for your access to or use of services provided by Technology Partners. Any interaction between you and a Technology Partner is solely between you and that provider.
By using features powered by Technology Partners, you acknowledge that your use is governed by the terms, conditions, and policies of each respective provider. It is your responsibility to review and comply with those third-party terms.
Elementor does not share customer content with any Technology Partner beyond what is required to provide the requested AI service.
Ally Widget
The Accessibility Widget is a tool designed to enhance website usability for individuals with disabilities. It offers a range of features to improve website accessibility including, but not limited to, text‑size adjustment and colour‑contrast control. The widget must be used reasonably and in compliance with our Acceptable Use Policy. Failure to adhere to these standards may result in limitations or suspension of your access to this feature.
User‑Provided Content
When you use the Plugin, you retain ownership of the content. However, you grant us and our service providers the right to scan, process, modify, and store this content as necessary to provide the service to you.
Platform Usage
The Plugin may offer a free version and one or more paid versions, as outlined on our pricing page. From time to time, we may introduce promotional or limited‑time plans. Upon payment for any paid version, in accordance with the terms outlined herein, enhanced access is granted. We reserve the right to change the charge terms and to modify all our plans at our sole discretion.
We may make one or more aspects of the AI features available for a trial period at no charge, at our sole discretion. Access to these features will end once you reach the usage limit, which may be changed at any time at our discretion. After the trial period ends, unless you purchase a subscription to the relevant AI features, you will no longer be able to use them.
AI Credit Allocation
AI credits are an allotment that lets paid subscribers use automated content services such as description rewriting or alt text suggestions.
Paid plans receive a fixed pool of AI credits each subscription year; credits do not roll over; when credits reach zero, AI features become unavailable until the next allocation or an upgrade.
Opening an Account
Upon installation, you are required to sign up and create an Elementor account or connect your current Elementor account. You are solely responsible for all actions with your credentials, including your username and password. Keeping your password safe is your sole responsibility. If you have any reason to suspect that your account was compromised or that there was unauthorized access to your account, you must immediately notify us so that we can work together to resolve the issue. We disclaim any liability for any loss or damage incurred due to unauthorized use by a third party.
Fees and Billing
Prices
If you purchase a paid plan you agree to pay the fees shown on the pricing page.
Payment authorization
You authorize Elementor to charge your stored payment method for all applicable fees.
Fee changes
We may change or add fees after giving reasonable advance notice. You may cancel before the new fees take effect.
Non-refundable
All payments are final and non-refundable.
Billing Information
You must keep your billing details accurate and current.
Automatic Renewal
Paid plans renew at the end of each billing period unless cancelled before the renewal date.
Usage quotas
Each plan includes usage quotas as described on the pricing page and in the Fair Use Policy.
Failed payments
If a charge fails we will retry within a reasonable time. If retries fail the subscription may be suspended or cancelled.
Taxes
Prices do not include taxes. You are responsible for any taxes that apply to your purchase.
Support
Paid plans include reasonable support for the account holder.
Termination
We may terminate your access to the Plugin, as well as any plans and services, at any time and for any reason at our discretion, including but not limited to a violation of these terms, with or without notice. Upon termination, you shall immediately cease using the services.
Any clause that includes a representation or warranty shall continue to apply, including any covenant or obligation on your behalf to pay fees, if applicable.
We shall not be liable for any damage caused to you or any third party as a result of terminating these Terms or by suspending or otherwise limiting your use of the services.
After a downgrade or cancellation the following rules apply:
- Scanning – New scans and automated checks stop as soon as the change takes effect, while previously generated audit reports remain accessible for the retention period stated in these terms.
- Overlay fixes – Adjustments that are injected at page load such as contrast toggles or skip link overlays stop functioning because they rely on active service calls.
- In origin fixes – Edits written directly into the site code or database such as saved alt text or aria labels remain in place because they reside inside the customer environment.
- Widget – If the new tier does not include the accessibility widget the toggle disappears from the interface, though any preference cookies already stored on visitor devices will persist until they expire.
If we become aware of any violations of these terms related to your uploaded content, we may notify you and request corrective action. Failure to address such violations may result in the termination of your access to the Plugin.
Intellectual Property and Aggregated Data
Except for AI-generated output that you own, all Plugin code, designs, and aggregated non-personal data are the property of Elementor. Elementor may use aggregated and de-identified data to improve its products, develop new features, and for analytics.
Warranty and Liability
The Plugin is provided “as is” without warranties of any kind, whether express, implied, or statutory. Elementor disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. Elementor’s cumulative liability arising from the Plugin will not exceed the fees paid for the Plugin in the twelve months preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be limited under applicable law.
AI Output Disclaimer
Regarding the content generated by AI (“Output”), it is created by automated systems and is used at your own risk. The Output may be inaccurate, offensive, repetitive, or similar to content generated for other users. It may also infringe the rights of others. You should not rely on any Output without independently verifying its accuracy, legality, and suitability for your specific use case.
Elementor does not guarantee that any Output is correct, useful, original, or non-infringing. Elementor does not review or endorse the Output and is not responsible for any consequences that result from your use of it. We recommend seeking professional or legal advice before relying on or distributing any Output.
You are solely responsible for using AI features in compliance with all applicable laws and with the terms of any Technology Partner involved. The AI services and their outputs are provided “as is,” without any express or implied warranties, including those of merchantability, fitness for purpose, or non-infringement.
AI features may be released in beta. This means they may contain bugs, have limited functionality, or behave unpredictably. By using these features, you agree that: (a) results may be inaccurate or incomplete; (b) features may change without notice; and (c) data may be lost or corrupted.
If Elementor receives a takedown or removal request related to content generated or used with this Plugin, we may remove such content at our sole discretion, with or without notice. We also reserve the right to inform the reporting party of the action taken.
Because this Plugin includes AI-generated content, there is a possibility that content may unintentionally replicate or resemble copyrighted material. If you believe that your copyright-protected work has been used through Elementor’s services without your authorization, you may contact: [email protected] to request that the content be removed. Elementor may, at its sole discretion, remove such content in whole or in part, with or without notice, and may notify the person or entity who submitted the removal request.
Your Responsibility
As the user of the Plugin, you are fully responsible for how it operates on your website. This means you need to test the Plugin to ensure it functions correctly and doesn’t negatively affect your site’s accessibility. You should carefully review any findings or recommendations provided by the Plugin before making changes to your content or code. It is also your duty to make sure your website complies with any accessibility laws or standards that apply in your location or industry.
You are solely responsible for any content you use with the Plugin. By using the Plugin, you confirm that you have the legal right to use, upload, and process that content. This includes ensuring it doesn’t violate any intellectual property rights, laws, or contain harmful elements like viruses or malware.
You must also respect any limits described in the Fair Use Policy below and any additional terms displayed on the pricing page and/or any additional page inside the admin management panel. By continuing to use the Plugin, you confirm that you hold all necessary rights and permissions, that you will comply with all applicable laws, and that you are not located in or affiliated with any restricted regions or entities under U.S. law. Furthermore, you confirm that you have not been previously banned from using this Plugin or related services by us.
Each execution of the detection engine counts as one scan under the quota defined in the Fair Use Policy. Excess scanning beyond the quota may be suspended until the next renewal period or until an upgrade to a paid plan is completed.
Fair Use Policy
This policy explains how scan quotas and other usage limits work and sets the ground rules that keep the service reliable for everyone.
You receive a scan quota and any other usage allowances that are listed for your plan on the pricing page or within the Plugin’s admin screens (“Plan Limits”). Your quota renews at the interval shown for your plan. The Plugin is intended for reasonable use under each plan, and usage should remain within fair and expected boundaries.
Attempts to bypass or artificially extend your Plan Limits, such as by creating duplicate accounts for the same site, running automated scripts to trigger scans, or reverse-engineering the service, are strictly prohibited.
If you exceed your Plan Limits, we may pause further scans, limit functionality, or invite you to upgrade to a higher-tier plan. While we make an effort to notify you when you’re approaching your quota, it is ultimately your responsibility to monitor usage.
We may restrict or suspend your access, with or without notice, if we detect activity that degrades performance for others, exceeds reasonable use, violates this Fair Use Policy, or appears fraudulent, harmful, or unlawful. Excessive or abusive use that negatively impacts our hosting infrastructure, web servers, or other users may also result in account suspension or termination.
We reserve the right to update this Fair Use Policy at any time. Material changes will be communicated through the Plugin interface or by email. Continuing to use the service after the changes take effect means you accept the updated policy.
Modifications to Terms
We reserve the right to modify, update, or change these terms at any time. Notice of significant modifications will be provided through the Plugin interface or by other means of communication. It is your responsibility to review these terms periodically. Continued use of the Plugin after modifications constitutes acceptance of the updated terms. If you do not agree with the modifications, you may discontinue using the Plugin.
Indemnification
You agree to indemnify, defend, and hold harmless Elementor, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses, including reasonable attorneys’ fees, arising out of your failure to comply with these terms, including but not limited to claims related to copyright infringement, regulatory violations, or harmful elements in your content.
Advertising
Our services may display ads. We do not endorse or monitor these ads or their content and are not responsible for them, even if they appear affiliated with us.
Privacy
Content submitted for scanning is processed automatically in memory and not stored after the result is returned. Elementor, therefore, keeps no raw crawl data, screenshots, or backups, and nothing needs to be purged when an account is closed or a subscription ends. If a plan lapses, the Plugin simply stops operating on the customer’s site.
For the transient AI processing described above, Elementor acts as a data processor, and Cloudflare acts as a sub-processor. In all other respects, content remains solely in your own environment.
Use of the Plugin is also subject to the Elementor Privacy Policy, which explains how we handle any personal data collected outside the Plugin, and a list of sub-processors is published at https://vvdryvat.top/about/privacy/. By using the Plugin, you agree to the Elementor Privacy Policy, as well.
Where applicable, Elementor is the data processor of its Plugin users’ visitors and users’ data, which we process on behalf of our Plugin users, who are the data controllers of such data. Such processing will be in accordance with the Elementor Plugins Data Processing Agreement (“DPA”). In these instances, our Service Providers processing such data will assume the role of sub-processors.For the avoidance of doubt, each Plugin user is solely responsible for providing adequate notice to their visitors and users whose personal data may be processed – including sufficient reference to the processing of their personal data via the Plugin, and any other information necessary to comply with all applicable privacy and data protection laws; and to obtain all approvals and consents from such individuals as required under any applicable laws.
Trademark Guidelines
Use of Elementor trademarks is governed by the Elementor Trademark Policy.
Governing Law
These terms are governed by and construed in accordance with the laws of Israel, and any disputes will be subject to the exclusive jurisdiction of the courts of Tel Aviv‑Yaffo.
